Question- DUII vs DWI vs DUI?

  • Answer - Legally there is no difference between the 3 different terms, they are just different ways of saying the same thing. "DUI" refers to "Driving Under the Influence", DWI refers to "Driving While Intoxicated" and "DUII" refers to "Driving Under the Influence of Intoxicants".

Question- When charged with a DUI in Oregon, what should be my first course of action?

  • Answer - DUIs are serious offense and often carry hefty penalties, your immediate reaction should be to contact a DUI attorney. When charged with a DUI, you have a limited amount of time before you license is suspended and a DUI attorney could possibly stop this from happening. Never begin speaking to law enforcement before speaking to your attorney.

Question- Is my license subject to suspension after a DUI charge?

  • Answer - If you have been charged with a DUI due to a Field Sobriety Test, you have up to 10 days to request a DMV Implied Consent Hearing. This will allow you to present your case to the DMV in order to possibly retain your driving privileges while your case is being tried in court.

Question- May I apply for an Oregon Hardship Permit?

  • Answer - If you have received a license suspension due to a DUI you may request a hardship permit from the State of Oregon. A hardship permit will allow you to drive to and from work, or any other official reasons that are approved by the court, such as: medical appointments, rehabilitation appointments, and employment opportunities.

Question- Can I refuse to take a DUI blood or breath test?

  • Answer - Many states, including Oregon, have an "implied consent law" that automatically consents drivers to DUI tests. If you do not submit to a test when being pulled over for a DUI your license may be suspended for up to one year.

Question- Is being under the influence of drugs the same thing as alcohol?

  • Answer - Regardless of the substance, if you are intoxicated while operating a motor vehicle you are subject to receiving a DUI.

Question- What are the penalties for a first time DUI offender?

  • Answer - If you have more than one DUI charge within the past couple of years you will be subject to increased penalties, but penalties typically involve fines, license suspension, and the possibility of jail time. However, it all depends on the circumstances of your DUI, those who have done harm to others while intoxicated are subject to harsh penalties and different charges.
